With or without a Visa, close to 19% of France’s population is comprised of foreign-born immigrants. The day after the 2016 presidential election, immigration websites to Canada and France crashed from a deluge of traffic. French president Emmanuel Marcon encouraged scientists and other academics to consider making France their home. If you’re interested in moving to the south of France, with its picturesque countryside and a distinct, beautiful culture, there are a lot of things you need to consider. Mainly, the paperwork involved in moving to the south of France can be daunting, and it can be difficult to know where to start. Read on to find out how to move to the south of France with minimal hiccups and headaches. 

  • Find the nearest French consulate. 

For anyone wishing to visit France for three months or less, all you’ll need is a travel visa. But for those who want to move permanently, things can get a little more complicated. It can take up to five years to obtain permanent residency in France. 

The first thing you’ll need to do to begin your journey to permanent residency is to find the nearest French consulate. Unfortunately, French consulates are few and far between, so you’ll want to be prepared to travel. In most cases, one French consulate will serve a cluster of states. Once you locate the nearest consulate, you’ll want to figure out which type of visa you’ll need to move to France. 

What are the most popular French visas?

  • Spouse Visa

If you’re married to a French citizen, you can get a 12-month visa, but you’ll have to register at the Immigration Office within the first three months after you move to the south of France. Your registration and spouse visa will count as a proof of residence card. 

It can take up to three weeks for the Immigration Office to complete your registration and spouse visa, so don’t wait too long. The application is free, but you will need a lot of supporting documents to complete the registration. Documents include your proof of marriage, in English and in French, and also the completed application forms, proof your husband or wife’s French nationality, and a completed residence form. 

  • Work Visa

The most challenging part of obtaining a work visa is that you have to get a job in France first. Once you obtain a job, you’ll need to get your work contract approved by the French Labour Ministry, which is also part of the Immigration Office. If your family is coming with you on a work visa, you’ll need to have your French employer start a file for your family members, too. It can take up to three weeks to get a work visa approved. As far as documents go, you’ll need to complete the work visa application forms, residence forms, and you’ll also need to pay a processing fee of around $100.

  • Student Visa

Student visas only cost $50 and take about two weeks to process. But you will need a series of documents from Campus France, financial guarantees, and proof of enrollment plus other forms to get approved. Read more info about a Student Visa for France.

  • Visitor Visa

If you’re staying for more than three months, but you don’t have a job in France, a French spouse, nor are you going to school in the country, then you’ll want to apply for a visitor visa. A visitor visa usually takes around one month for the Immigration Office to complete. You’ll need to complete a list of questionnaires, application forms, and a letter of explanation where you inform the authorities of what you intend to do while in the country. You’ll also have to tell the Immigration Office in writing that you will not work in France, show proof of how you will support yourself financially, proof of earnings, medical insurance, and accommodation. The processing fee is $100. 

  • Au Pair Visa

If you’re a student between 17 and 30 years old, you could apply for a year-long au pair visa. The French Ministry of Labour approves au pair contracts where you’ll need proof of an invitation from your host family, and you’ll also need to sign up for French language courses to get an au pair visa. 

Once you’ve stayed in France for a year, what can you do next to move to the south of France permanently?

You’ll want to apply for a residency permit at least two months before your visa expires. If you’re able to obtain a residency permit, you can legally stay in the country long-term. You’ll need supporting documents to take to the local prefecture to apply for a residency permit. What you’ll need to prove are things like:

  • Your family situation
  • Your financial resources
  • Proof of employment or a work contract
  • Your address

Sometimes the authorities will require more documents, but once you’ve lived in the South of France for at least five consecutive years, you’re eligible for a permanent residency. You’ll need documents to prove how long you’ve lived in France along with other supporting documents to show that you have a secure financial situation. Also, you’ll need to prove that you can speak French well enough to live there permanently.

The south of France is one of the most beautiful places in the world, and it is home to a rich and diverse culture. But with any international move, the paperwork is usually the most demanding part of obtaining permanent residency, and France is no different. Once you apply for a temporary, 12-month visa, make sure you keep your documents stored in a safe, accessible place and keep them organized. It’s also a good idea to make copies so that you are well-prepared to fill out the applications for permanent residency and get approved.

The French tax system is a constantly changing maze of laws, treaties and convictions with sometimes good news at the exit. Like now! If you have sold a second home in France, you can finally claim money back from the tax department. The French parliament has adopted a bill to definitively abolish the levying of social contributions on 1 January 2019.

Reclaiming money from the French tax authorities is of course not without a struggle; there are even 15,000 files waiting for you for treatment. So when they finally start with your file, it is important to have prepared your case well and thoroughly.

Remind me again about ‘plus value’?

Article 19 of the bill for the financing of social security 2019 stipulates that as of 1 January 2019 no social contributions (rate 17.2%) will be imposed on persons who are already subject to the social security scheme of another European Union member state or European Economic Space Member State or Switzerland.

As of 1 January 2016, France has introduced repair legislation to circumvent the De Ruyter judgment, but the Court in Nancy also declared this new legislation to be in violation of the EU regulation on 31 May 2018. More than 3,000 procedures are currently underway for the tax years 2016, 2017 and 2018. For the year 2017 alone, the unpaid social contributions by non-residents amount to more than 285 million euros.

Less capital gains tax

This puts a definitive end to the unsustainable position of the French government to continue to levy double social contributions while it was always clear that this would be in conflict with the ban on the cumulation of social security legislation (EU regulation 1408/71). In short, good news for foreign people in the EU with a second home in France. As a result of the amendment of the law, the tax rate for EU citizens who make a profit on the sale of a second French home (so-called plus-value) will go from a maximum of 42.2% to 25%; a big improvement!

This change in law is of great importance for owners of secondary houses in France. From a capital gains tax standpoint in case of a sale such owners today still become subject to personal tax in France at a fixed 19% income tax rate plus 17,2% social contributions, i.e. in total 36,2%. An additional taxation applies for any capital gains derived from the sale of a property that exceed € 50.000.

The tax rates vary from 2% to a top rate of 6%. Thus, in case the total capital gain exceeds € 260.000 the maximum capital gains tax rate, applicable today can amount to 36,2 % plus 6%, i.e. 42,2,%. As from January 1st, 2019 for persons already subject to social contributions in another EU Member State (or Switzerland or the European Economic Area)  the tax rate will go down to maximum 25%!

The change in law will also have a positive effect for owners that receive furnished or unfurnished rental income from French property. As from January 1st, 2019 they will only pay personal income tax (with a minimum tax rate of 20%).

Last but not least France could even become quite interesting for wealthy private individuals, because the flat tax rate of currently 30% on income from capital (interest, dividends and capital gains on sales of shares and bonds) will go down to 12,8% which corresponds to the levy of personal income tax.

Of course one has to be able to proof that he/she is subject to the social security system of another EU Member State (or Switzerland or the European Economic Area). Only then one can escape the levy of the French social security contributions. Unfortunately the new law does not apply for all other categories of foreign investors. For example an American, Russian, Indian or Canadian investor will still become subject to the French social contributions.

The pile of objections is growing

France was condemned by the European Court of Justice on 26 February 2015 in its judgment in Case C-623/13 Ministre de l’Économie et de Finances / Gérard de Ruyter, which resulted in a huge flow of objections. For the period 2012 to 2016, the French tax department received around 59,000 objections, of which 15,000 are still untreated.

Submit a notice of objection according to the French rules

How do you submit a clear notice of objection to the unjustly paid social contributions? Mr. Albert MULDER, lawyer in Aix-en-Provence shares with the readers of Living on the Côte d’Azur the simple rules.

What you absolutely must not do

Try to make a notice of objection in your best French with Google Translate. Of course it is almost certain that you are entitled to a refund if you have paid in error. Submitting a notice of objection in France is bound by strict procedural rules. If you do not comply with these rules, your notice of objection will be declared inadmissible and rejected. In many cases you can unfortunately no longer repair it at a later stage.

Use a lawyer or consultant who is not established in France. Article R 197-5 Livre des Procédures Fiscales states that a non-resident is obliged to choose domicile in France! For example, if you use a Dutch lawyer, there is a threat of a formal error.

What you should do

After a while, prescription expires, even in France. For example, if you sold your second home in 2016 and paid social contributions unjustly, you must submit your notice of objection by 31 December of this year! If you have sold in 2017 or 2018, fortunately you have more time. Therefore, call in a lawyer based in France. Even the keys of my keyboard have been a holiday as it has been a few weeks since I wrote something that was saved to stay. In our family, we were all overwhelmed by a general feeling of summery laziness, the so-called ‘laissez faire’ or ‘drop everything you can’ to enjoy the wonderful Mediterranean sea and the warm weather that does not seem to stop.

It actually started with the school holiday. Boom. The fixed rhythm of 7 AM wake-up and driving to schools followed by a walk with the dog along the beach was gone. Getting up early was suddenly not necessary anymore and surprisingly we exchanged that school rhythm just as easily for the rhythm of summer: get up when you feel like it and think while standing with your feet on the warm terrace if you would start the day with a lazy bomb or a sporty dive in the pool.

During the afternoon, when the sun is roaring, we embrace each other and the ritual that is called siesta while the children look for a shade near the water. They live these weeks on the beach with friends and come sunburnt home at the end of the day; tired of laughing and full of stories. That is usually the time for a barbeque or a large salad.

Of course, work is still being done; writing and talking about new plans, and talking with project developers who have purchased a new piece of land wherein 2021 a beautiful apartment complex appears. We drive around the backland to the sea and back with clients from all over the world and listen carefully to the stories of buyers from abroad; people who all live nicely, have a good job and still want to reward their lives with a second summer house in the South of France. When we ask about the reason for their purchase, the answer is certainly and clear: ‘South France means enjoying life and offers many possibilities in the immediate vicinity.’

And so it is; it is exactly the reason why we do not leave here anymore. The beach in Tahiti will undoubtedly be more beautiful. But can you also ski there? And the restaurants in the Florida Keys probably have better service and larger steaks, but is the environment varied enough? And in the Amsterdam Vondelpark you can have a nice jogging run, but is it ever quiet? And Portugal has beautiful beaches, but is the water warm enough to swim? The beauty of the Alpes Maritimes region is that it has a place for everyone and for every wish. From a perfectly constructed 18-hole golf course to dizzying water slides and from stylishly strolling on the boulevard to a tough walk through the rugged mountains in the hinterland. It’s all possible on the Côte d’Azur and always accessible within an hour.

Meanwhile, we roll into August and the temperature is now also 30 degrees at night. In a house, without air conditioning, the fans hum on each floor and the dog is panting in the coolest spot. For the animals, it is a tough period and a cooling walk around a lake in the mountains is a nice distraction for all of us. Before we know it , we get up at 7 o’clock again and schools start. And then, the second part of the summer begins. For parents, September and even October is the most beautiful month of the year.

The ‘Indian summer’ means that the parking places near the beach are empty and the sea still beckons invitingly. The permanent beach clubs are happy to see you again; locals who are in no hurry. A pan Bagnat on Plage Salis in Antibes tastes best when the sand is not so hot under your feet and you can park the car normally on the beach front. We roll out the Sup and paddle along the coast over a calm sea while looking at the mountains. Behind it, there lies Europe with the bustle of overcrowded motorways, madness, and polemics. We look at it and praise us fortunately that we can enjoy peace, space and beautiful views at the bottom of Europe.

Buying a second home in the South of France is, of course, a fun and important event in your life. From the moment you have reserved the purchase, you’ll immediately feel a lot happier. Not that this has been proven scientifically, but we know from experience that our customers all travel to southern France with a smile on their face to enjoy a few days of local life on the Côte d’Azur.

If you are considering buying a new apartment or an existing villa on the French Riviera, it would be a good idea to make a purchase this year. You save more than one percent on the total purchase as from 2019 the rates of French notaries are unfortunately going up. Notary fees in France will increase as of 2019

Not that the notary is getting richer here; his or her activities for a real estate transaction consist of 80% of collecting taxes for the French government. The remaining 20% of the costs are incurred on file costs and administration time the office has to make. Anyone who has ever bought an existing or new apartment or villa on the Côte d’Azur knows that there is a lot of paperwork involved. The structure is simpler for new constructions, but everything has to be signed in triplicate because your purchase of newly built real estate must be stored – on paper – in all possible registers in, for example, Paris and the local and national land register. And paper, the French love it.

Every notary, therefore, has an impressive paper archive to store the transactions. Can’t that be done digitally ?, I hear you think, but strangely enough, the paper is safer. A server with all documents can be cracked or simply stop working. Digital is, therefore, a ‘nice to have’ and to sue in the mail, but for the time being and in this respect, the paper is more sustainable.

So if you are buying an apartment this year, try to send it to sign your final purchase agreement with the notary before the end of the year. On a new apartment of 600,000 euros, it makes a difference between six and twelve thousand euros.

Shopping on the Côte d’Azur is, for many people, an integral part of their stay on the French Riviera. It is not surprising because many French high fashion brands have flag stores to entice international visitors to South France. In Monaco, Nice and Cannes, you will find almost all top brands such as Dior, Christiane Lacroix, Dolce & Gabbana, Versace, and many others.

Shopping is, therefore, a severe way of spending your holidays. Between Nice and Cannes are two XL shopping malls, both fighting for the attention of the tourist that gladly spends a few hundred euros on fashionable goods. The CAP 3000 is, for many, the largest shopping mall, but since 2015 Cagnes sur Mer has offered a pleasant alternative; Polygone Riviera. It’s different to choose one only; the best is to visit them both as they both are very different in style and ambience.

CAP 3000

The CAP 3000 shopping centre was launched in 1969 and is located by the sea. They did nothing with that seafront for a long time: the back side was almost closed and the official entrances were divided over an immense car park. In 2014, plans were announced for a new competitor in Cagnes-sur-Mer; Polygone Riviera. Barely ten kilometres away and full of ambition.

Since then, CAP 3000 has been working hard to avoid losing the battle for acquisitive tourist and the local public. At first, a new parking garage appeared to solve the long-term lack of parking problem. Meanwhile, work on the exterior started to create an extension.

Shopping Cote Azur: Polygone Riviera versus CAP 3000  

New ceilings, new floors and a mega-sized digital screen in the middle of the hall make the whole thing very impressive. The new CAP 3000 is a super design shopping centre with 85,000 square meters. Exactly 10,000 square meters more than competitor Polygone, which has already announced that it will build a new zone with a further 25,000 meters of shops. The builders will have enough work for the following years: Cap 3000 recently announced another 50.000 square meters of shopping fun. And the seaside is now a lovely foodies area with large terraces. The result is that you might be confused when you drive towards Nice from Cannes. Many look at the mega parking floors and think this is the airport! Especially at night, you can be fooled;-)

Lunch or dinner by the sea

By opening up the rear side, the CAP has an additional trump card with funky, new restaurants with sea views. The parking problem has been solved; capacity has more than doubled, so more people can be received simultaneously. The CAP 3000 is everybody’s favourite because of the air conditioning during hot summer days.

Apple Genius Bar

Interesting to visit; the most significant trigger, of course, is Galerie Lafayette. This Parisian department store takes up almost half of the CAP 3000 and is a shopping centre on its own. Another magnet is the Apple store, which features a Genius bar, so you are welcome for repairs, training or advice early in the morning. Another unique feature is the Monprpix supermarket; open all day with a large choice of quality food and traiteur.

In the field of complete luxury shopping malls, there are two most active and innovative in the battle for the tourist. In Saint Laurent du Var (near Nice) the CAP 3000 and Cagnes sur Mer offers you since 2015 Polygone Riviera. Both are impressionable shopping malls and have several extras that make them almost incomparable. According to the centres, the number of square meters of shopping space counts. But for spoiled shoppers, it’s more than that: it’s also about ambience and style. But that’s so personal, so we’ve made an overview for you to choose from!

Polygone Riviera

Polygone Riviera is located on the ‘pungent’; long access road from Vence to Cagnes-sur-Mer, towards the sea. Long has this been a soulless wasteland, with finally a new Casino in 2012. Then the concrete train started to roll; many square meters were concreted into shops and plazas. Within three years, a shopping mall in the US-Florida style emerged. About 70,000 square meters offer more than 150 brands, divided into four zones. Polygone Riviera was the “Biggest shopping mall in Europe” for a while, but that title has been handed over to CAP 3000 (read further!).

Entertainment Shopping

The concept of Polygone Riviera can best be translated into ‘shopping entertainment. After you have parked underground or have used the ‘valet’ service, you enter the ‘theme park’ via the escalators. You will be surprised by that Disneyland feeling. There’s a happy atmosphere because you are partly outside and partly covered shopping. There is (live) music, and terraces at French or Italian-style cafés invite you to a delicious Café Latte. Polygon has no long galleries with stores CAP 3000 but serves a mix of cosy restaurants interspersed with varied shops. While CAP 3000 offers much of the same kind of fashionable shops, Polygone has opted for diversity in supply. Polygone has a pond, water fountains and fresh air, but on very hot days, you stay longer ‘fresh’ in CAP 3000. And if it rains,  large glass panels are provided as a roof, but you might want to use the free umbrellas.

The concept of Polygon Riviera is divided into four areas;

Le Quartier des Saveurs

The trendsetting place for anyone who loves good Mediterranean food. You will find more than twenty great restaurants in the Dining Plaza at reasonable prices. The local audiences and tourists provide a crucible which carries a lively atmosphere and delicious smells of grilled meat and fish.

Le Quartier des Aracades

This is a prominent square Italian example with shopping arcades located under high arches. More than seventy shops, trendy shops like Massimo Duti or Cos and new iconic brands like Tesla Cars. It’s also home to the prestigious Printemps department store.

La Promenade des Palmiers

A broad area with more than 40 boutiques ranging from Zara, H & M, Levi’s to Superdry. Also, Forever 21 is finally here. French fans had this go to Paris to buy something fashionable for a small price. And of course, Primark is here; the first on the Cote d’Azur and already the most popular store.

On the Promenade des Palmiers is also room for entertainment, with a casino that offers many shows and a movie theatre that is larger than you expect from the outside. Ten cinemas with a ‘state of the art’ sound system show both French and VO (Original Version) movies. A wonderful day full of variety of shopping or just plain fun for a night out, that’s Polygone Riviera.

Designers Gallery

This angle design mixes with culture. A selection of over twenty exclusive brands, exclusive and trendy as By Collette. There is great attention to art and culture. Not only art in the Designers Gallery; in Polygone Riviera, you encounter striking artworks by French and international artists such as Ben, Céleste Boursier-Mougenot, Daniel Buren, Cesar, Pablo Reinoso and Wang Du. There are also temporary exhibitions in cooperation with local museums.

Polygone Riviera is a so-called four-star shopping mall. That means Polygone has to deliver an outstanding service. Polygone Riviera and CAP 3000 are worth a visit and can be seen as complementary in major brands such as Fnac vs Apple or Lafayette vs Printemps. Finally, the Cannes Film Festival has ended. Every year it is the same ritual with abundant rain that rinses almost all the stars of the red carpet. Today is the last day with drizzling weather and then the temperatures are far above 30 degrees. Yet there are people who claim that the weather has really changed because of climate change: ‘In the past, the summers were warmer.’ Or, ‘in the past, the winters were not that cold.’ Fortunately, there is a handy website where you can find the weather forecast for last year or ten years. ago. And guess what? Ten years ago it also rained a lot in May.

It also rains in the housing market, but then with buyers who all want to reserve the best spot. The Cote d’Azur remains extremely popular with all nationalities and the ever-growing madness of the housing market sometimes creates surprising moments. For example, two weeks ago we were in a green meadow two minutes from the sea with a couple who have been looking for a new apartment of 90-100 m2 for a year with a budget of 650,000 euros. That should be possible, but yes, with sea view in a quiet place, then you have to be able to decide quickly.

Gifts

Just when we found the ideal apartment, the prospective buyer made a comment that he would like to have the garage for free. I explained once again that there is too much demand for luxury new buildings to sprinkle with expensive gifts, but that we could always try it. When we wanted to enter the sales office to sign the reservation contract, the sales director came to me; “Abé, (that’s what the French call me because Ab is not a name) I have bad news, this apartment has just been reserved by phone.” And so we could do nothing but look at the grass that in this case seemed greener than ever. They could laugh about it, luckily.

A bit further away in Nice, people did not laugh at all this weekend, when more than 30 VTC drivers were demonstrating by driving slowly through the city. Not that someone really noticed the protest, but it made the newspaper. These drivers with those luxurious black-blinded vans complain of course about Uber, the handy taxi service that is many times faster and once again many times cheaper than these drivers that rip you off twice in front of your door. “May is normally a top month for us, but we had the Film Festival and that was very bad for us in terms of work. And for Formula 1, that also looks very bad.” Sad. Maybe they should start thinking about how to beat Uber instead of complaining. Something like more service maybe?

No, then the poor people in Monaco really have cause to complain; here the delivery of the post is structurally much later than people are used to, starting from June 11. The reason for this delay is the relocation of the sorting office from Nice Airport to Toulon. You do not hear me say anything about French efficiency measures, but it is always a long shot whether Post with the French mail arrives at all. You are much better off with e-mail for really important things. And otherwise, there are many similar actives at sharper prices such as in the region www.familyprocourrier.fr or www.step-post.fr, www.postcenter.fr or procourrier.fr

Fortunately, there is also good news to report: it is scientifically proven that optimists live longer. Despite all the grumbling, life expectancy on the Cote d’Azur is well over 80 years. Check out how old you become when you just be happy! The government expects that the number of elderly people aged over 80 in 2050 has doubled and so measures must now be taken in the area of care and housing. The first luxury old people’s homes with daily sports lessons, heated swimming pool, and 3-star restaurant have already been spotted.

Cool old timers

Not only people, cars also last longer and longer. I like to drive my own in my 12-year-old Volvo where many people go aside and I do not wake up with an extra scratch on the paint. And this summer we can use the 16-year-old Peugeot Cabrio of a friend. All those old-timers continue to do well thanks to strict MOT checks that are going to be even stricter. From this week cars are checked for no less than 610 points. For all this care the price goes up from 75 to 100 euros.

And that’s how we stay healthy together; with regular check-ups and of course good food. We are very much into bio gardening; in the end, the nutritional value of a tomato or zucchini is no longer what it was. In our greenhouse, unpressed peppers, tomatoes, cauliflower, courgettes and lots of herbs and lettuce grow. It is fun, tasty on the table and also surprisingly instructive. Because did you know that cucumbers prefer to hang in the sun? I suddenly look at vegetables very differently and like to participate in the rhythm of the cucumber, nicely in my hammock.
